Terms of Service

Agreement to Terms

By creating an account or using Sitter ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and Heath Foundry, LLC, the company that operates Sitter.

Eligibility

You must be at least 18 years old to create an account. Each household may have one Sitter account. By creating an account, you represent that you are at least 18 and that you have consent from any sitter whose phone number you add to the platform.

The Service

Sitter is a coordination platform that helps families connect with their trusted babysitters via SMS. Sitter is not a childcare provider, staffing agency, or background check service. We facilitate communication between families and sitters they already know and trust. We do not guarantee sitter availability or the quality of any childcare arrangement.

User Responsibilities

Parents: You are responsible for vetting and selecting your own sitters. You must have consent from sitters before adding their phone number to the platform. You are responsible for all arrangements, payments, and agreements made with sitters outside the platform.

Sitters: By opting in, you consent to receive SMS messages from families using the Sitter platform. You can opt out at any time by replying STOP to any message.

SMS Terms

Sitter sends SMS messages as part of its core functionality — booking requests, confirmations, reminders, and status updates. These are transactional messages, not marketing. Message frequency varies based on your booking activity. Standard message and data rates from your carrier may apply.

Sitters can opt out of SMS messages at any time by replying STOP to any message from Sitter. Parents control their own notification preferences through account settings. We use Twilio as our SMS delivery provider.

Credits and Payments

Sitter uses a credit-based system to send booking requests. Credits are purchased in packs via Stripe. By purchasing credits, you agree to Stripe's terms of service for payment processing. Credits are non-refundable and have no cash value. Unused credits remain in your account indefinitely and do not expire.

If you enable auto-reload, credits will be purchased automatically when your balance falls below a threshold. You can disable auto-reload at any time from your Settings page. You are responsible for all charges resulting from auto-reload while it is enabled.

Subscription plans. Sitter may offer subscription plans (such as the Annual Plan) as an alternative to per-booking credits. Subscriptions are billed annually in advance via Stripe and renew automatically at the end of each billing period unless canceled. You may cancel your subscription at any time from the Billing page; cancellation takes effect at the end of the current billing period, and you will retain access to subscription benefits until that date. No prorated refunds are provided for partial billing periods. If we are unable to process your renewal payment, your subscription may be downgraded to the credit-based plan. Existing credit balances are preserved independently of your subscription status.

Usage limits. To protect against accidental overuse (such as automated integrations creating duplicate requests), Sitter enforces a monthly booking limit across all plan tiers. This limit is set well above typical household usage and is not intended to restrict normal use of the Service. If you believe you have a legitimate need for a higher limit, contact us at support@trysitter.com and we will work with you to accommodate your needs.

Google Calendar Integration

If you connect your Google Calendar, you authorize Sitter to read and create calendar events on your behalf for the purpose of managing bookings. You can disconnect your calendar at any time from Settings. Sitter's use of Google Calendar data is limited to booking coordination and complies with Google's API Services User Data Policy.

Referral Program

Sitter may offer a referral program that rewards families with credits for referring new users. Referral credits are subject to the same terms as purchased credits. We reserve the right to modify or discontinue the referral program at any time. Abuse of the referral program (e.g., creating fake accounts) may result in forfeiture of credits and account suspension.

Beta Features

Certain features may be marked as "Beta" and are provided on an experimental basis. Beta features may be changed, suspended, or removed at any time without notice. Beta features are provided "as is" without any warranties.

Cross-Family Sitter Sharing

When a sitter opts in to Sitter, their identity (name, phone number, and opt-in status) becomes available to any family that adds their phone number. This is how Sitter works — sitters opt in once and can be contacted by any family they sit for.

Families never see each other's rosters, bookings, rates, or any per-family settings. A sitter's single opt-in covers all families. Sitters can opt out at any time by replying STOP, which stops messages from all families.

Account Security

You are responsible for maintaining the security of your account credentials. Notify us immediately at support@trysitter.com if you suspect unauthorized access to your account.

Intellectual Property

All content, design, and software comprising the Service are owned by Heath Foundry, LLC and protected by applicable intellectual property laws. The Sitter name, logo, and branding are trademarks of Heath Foundry, LLC. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

You retain ownership of any data you provide to the Service (names, phone numbers, booking details). By using the Service, you grant us a limited license to use this data solely for operating the Service on your behalf.

Limitation of Liability

Sitter is provided "as is" without warranties of any kind, express or implied. We are not liable for any childcare arrangements, disputes, injuries, or damages arising from the use of the Service. The Service is a communication and coordination tool only.

We are not responsible for SMS delivery failures, carrier outages, or delays. In no event shall the total liability of Heath Foundry, LLC exceed the amount you have paid to us in the twelve months preceding the claim.

Dispute Resolution

Informal resolution first. Before filing any formal claim, you agree to contact us at support@trysitter.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If informal resolution fails, any dispute shall be resolved through binding arbitration administered under the American Arbitration Association (AAA) Consumer Arbitration Rules. Arbitration will be conducted on an individual basis — you waive any right to participate in a class action or class-wide arbitration.

Small claims exception. Either party may bring an individual action in small claims court instead of arbitration.

Governing law. These Terms are governed by the laws of the State of California. Any litigation (where arbitration does not apply) shall be filed in Marin County, California.

Termination

We may suspend or terminate your account for violations of these terms or for any reason at our discretion. You may delete your account at any time from your Settings page. Upon account deletion, any remaining credits are forfeited. Your data will be handled in accordance with our Privacy Policy.

Changes to These Terms

We may update these Terms of Service from time to time. For material changes, we will notify you via email or in-app notice at least 30 days before the changes take effect. The version number and effective date at the top of this page will be updated. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
